안녕하세요. 빅히트 뮤직입니다. 당사는 방탄소년단에 대한 명예훼손, 모욕, 성희롱, 허위사실, 악의적 비방 등을 담은 악성 게시물 작성자를 대상으로 정기적인 법적 대응에 나서고 있습니다. 이와 관련한 진행 상황을 말씀드립니다. 커뮤니티, 블로그, SNS 등에서 단순 의견 표출을 넘어 사회적으로 용인되지 않는 수준의 악성 댓글, 게시물 등을 지속적으로 작성하거나 유포한 이들을 대상으로 명예훼손죄(정보통신망 이용촉진 및 정보보호 등에 관한 법률 제70조) 및 모욕죄(형법 제311조) 등의 혐의로 고소 조치를 완료했습니다. 기존 고소건 중에 최초 고소장 접수 후 다음 해에 피의자 소재 불분명으로 기소중지되었으나 약 1년 후 피의자 소재지가 다시 밝혀지며 보완수사 요구 처분이 결정된 사례가 있었습니다. 또한 형사 처분이 완료된 건에 대해서는 민사상 손해배상 청구를 접수했습니다. 이처럼 다소 시간이 걸리더라도 당사는 끝까지 악성 게시물 작성자에 대해 법적 책임을 물을 것이며, 피의자 신원 확보 및 수사 기밀 유지를 위해 그밖에 구체적인 과정이나 진행 상황을 공개하기 어려운 점 양해 바랍니다. 앞으로도 악성 행위자들이 강력한 법적 처벌을 받을 수 있도록 엄중히 조치를 취할 것이고 기존과 마찬가지로 어떠한 경우에도 합의나 선처는 없음을 알려드립니다. 방탄소년단에 대한 악성 게시물 수집과 신고, 법적 대응은 정기적으로 이뤄지고 있습니다. 빅히트 뮤직 소속 아티스트 관련 사안은 새로운 빅히트 뮤직 법적 대응 계정(protect@bighitmusic.co.kr)으로 팬 여러분의 적극 제보 부탁드립니다. 방탄소년단을 향한 팬 여러분의 사랑과 헌신에 늘 감사드립니다. 아티스트의 권익 보호를 위해 끊임없이 노력하겠습니다. 감사합니다. --------------------------------------------------------------------------------------------------------- Hello. This is BIGHIT MUSIC. Our company regularly initiates legal proceedings against perpetrators of malicious activities related to BTS, including ill-intentioned criticism, the spread of groundless information, sexual harassment, personal attacks and defamation. We would like to provide an update on these activities. We have filed criminal complaints for defamation (Article 70 of the Act on Promotion of Information and Communication Network Utilization and Information Protection, etc.) and insult (Article 311 of the Criminal Act) against perpetrators who engaged in repeated posting or spreading malicious replies and writings exceeding the boundaries of socially-acceptable expression of opinions on online communities, blogs and social media. In addition, a stay of proceedings that had been issued for a previous complaint due to uncertainty of the defendant’s place of residence was lifted after the perpetrator was newly identified and law enforcement ordered additional investigation. For cases where the criminal complaint was concluded with a sentencing, we filed additional civil suits for damages. As can be illustrated by these examples, our company is committed to the relentless pursuit of perpetrators of malicious postings; we ask for your understanding that we may be unable to release further details or comment on pending cases to ensure that perpetrators can be identified and investigations remain confidential. We will continue to initiate strict measures to ensure that perpetrators who engage in these malicious acts are prosecuted to the full extent of the law, and our policy of no settlement and no leniency remains in effect. BIGHIT regularly collects information on malicious postings regarding BTS, reports them to the authorities and files criminal complaints.
