안녕하세요. 빅히트 엔터테인먼트입니다. 당사는 방탄소년단에 대한 명예훼손, 모욕, 성희롱, 허위사실 유포, 악의적 비방 등을 포함하는 악성 게시물 작성자를 대상으로 정기적인 법적 대응을 진행하고 있습니다. 이와 관련한 진행 상황을 알려드립니다. 최근 당사는 팬 여러분의 제보와 자체 모니터링을 통해 수집한 증거 자료를 바탕으로 수사기관에 고소장을 제출했습니다. 주요 증거 대상은 디시인사이드와 같은 각종 커뮤니티, 티스토리를 포함한 블로그 게시물 등이며 그밖에 SNS 게시물, 포털사이트 뉴스 댓글, 음원 사이트 댓글 등도 해당됩니다. 이전 진행한 고소 건 중 일부 피의자는 벌금형을 선고받았으며 나머지 피의자들도 조사가 진행되고 있습니다. 이 과정에서 조사 중인 피의자가 대리인을 선임하여 합의를 요청하는 사례가 있었으나 원칙에 따라 절대 선처 불가 의사를 전달했습니다. 특히, 장기간 악질적으로 방탄소년단에 대한 악성 게시물을 작성해온 이들의 정보를 수집하여 경찰에 전달했고, 그중 일부는 경찰 조사에서 범죄 혐의가 인정되어 검찰에 송치 후 처분을 기다리고 있습니다. 만약 법원의 판결 이후에도 계속해서 범죄 행위를 일삼을 경우, 추가적인 고소는 물론 강력한 민사상 손해배상 청구까지 조치할 계획입니다. 악성 게시물에 대한 법적 대응은 당사 법무팀 주관으로 전문 법무법인과의 긴밀한 협업 하에 진행하고 있습니다. 제3자가 제기하는 고발은 피해자인 아티스트 본인의 경찰 출두와 조사가 원칙이므로, 개인 또는 단체 등 제3자 고발에 대해 회사 차원의 협조와 지원은 어렵다는 점을 양해 부탁드립니다. 또한 사건별로 고소장을 제출하고 사건이 종결되기까지 적게는 수개월에서 길게는 1년 이상의 긴 시간이 소요됩니다. 따라서 다소 시간이 걸리더라도, 아티스트 권리 침해에 대한 당사의 대응 의지는 확고하니 이 점 이해해 주셨으면 합니다. 당사는 상시적인 악성 게시물 모니터링을 통해 지속적으로 증거를 수집하고 있으며, 악성 게시물 신고 및 삭제 작업도 동시에 진행 중입니다. 앞으로도 빅히트 법적 대응 계정(protect@bighitcorp.com)으로 적극적인 제보 부탁드립니다. 방탄소년단을 향한 팬 여러분의 애정과 헌신에 늘 감사드립니다. 아티스트의 권익 보호를 위해 끊임없이 노력하겠습니다. 감사합니다. --------------------------------------------------------------------------------------------------------- Hello, This is Big Hit Entertainment. Big Hit regularly initiates legal proceedings against perpetrators of malicious activities related to BTS, including ill-intentioned criticism, the spread of groundless information, sexual harassment, personal attacks and defamation. We would like to provide an update on these activities. Recently, Big Hit Entertainment has filed several complaints to law enforcement agencies based on evidence collected by our fans as well as through our own monitoring initiatives. These include postings on online communities such as DC Inside, blog postings on sites such as TISTORY as well as social media postings, comments on news articles on Web portals, and comments on music streaming sites. Several of the perpetrators identified in these cases have been sentenced to fines, while investigation continues against others. Some individuals under investigation have made requests for settlement through their legal representatives, but Big Hit made it clear that no settlements will be forthcoming as we continue to adhere to our policy of zero tolerance. In addition, information was collected on individuals with a long history of malicious postings about BTS and provided to the police. Criminal complaints were filed on these individuals by police and these cases have been transferred to the prosecutor’s office. If these individuals continue to engage in their criminal activities, Big Hit will file additional complaints as well as initiate civil proceeds to the maximum extent possible. Our response to malicious postings is being mounted by our legal department in close coordination with a legal firm. Please understand that as complaints brought by third parties necesitate the summons and questioning of the artists involved by law enforcement, it is difficult for Big Hit to assist with criminal complaints field by third parties including individuals and organizations. As the process from filing a complaint to the conclusion of a case can take months to more than a year, we ask for your understanding as we remain firmly committed to responding to the utmost extent of the law against any infringement of our artists’ rights. Big Hit continues to collect evidence by closely monitoring malicious postings, as well as reporting and deleting such content.
